Mullivaikkal is not just a sorrowful event of the past; it is a living testimony that exposes the contemporary political reality of Tamils and the challenges they still face today for their very existence before the world.

In the final months of the civil war in Sri Lanka in 2009, tens of thousands of Tamil civilians were killed in the most brutal manner. International organizations and human rights groups have documented the gravity of this disaster through various studies. The official report of the Panel of Experts appointed by the Secretary-General of the United Nations estimated that at least 40,000 civilians may have lost their lives in the final phase of the war. Deeply analyzing the Sri Lankan government’s own census data, the Most Reverend Bishop of Mannar, Rayappu Joseph, officially revealed that 1,46,679 Tamils were unaccounted for (either forcibly disappeared or killed). Based on subsequent extensive testimonies and demographic data, the International Truth and Justice Project (ITJP) has estimated that the total number of casualties could be up to 1,69,796. All these data prove to the world that what happened in Mullivaikkal was not just the final chapter of an ordinary war, but a systematically executed human catastrophe.

During the war, hundreds of thousands of civilians, including women, children, and the elderly, were instructed to move to areas declared as “No Fire Zones” by the Sri Lankan government. However, unfortunately, those very safe zones were subjected to continuous and intense bombardment and artillery attacks. Temporary hospitals, food distribution centers, UN shelters, and civilian places of worship, which should not have been subjected to any attacks under international humanitarian law, were deliberately targeted. According to testimonies provided by surviving civilians, doctors, international journalists, and human rights organizations, severe allegations have been recorded regarding the use of internationally banned lethal chemical and sharp weapons, including cluster bombs and white phosphorus, against the people.

In the final days of the war, trusting the guarantees of the international community, Tamil political and administrative leaders who surrendered holding white flags, as well as thousands of civilians and youth handed over directly to the military by their families, were forcibly disappeared. No information has been released to date about where most of them are or what happened to them. With the single question for justice, “Where are our children?”, the mothers and relatives of the forcibly disappeared have been waging continuous protests on the streets for more than sixteen years, despite their advanced age. The tears and struggle of these mothers remain a poignant question mark shaking the conscience of the world.

In the eyes of global Tamils, the Mullivaikkal atrocity is a systematically planned ‘Tamil Genocide’. According to the United Nations Convention on the Prevention and Punishment of the Crime of Genocide, any acts committed with the intent to destroy, in whole or in part, a national, ethnical, racial, or religious group constitute genocide. Many international legal experts emphasize that the disproportionate attacks on Tamil safe zones, the prevention of food and essential medicines from reaching the battlefield, the unlawful disappearance of those who surrendered, systematic sexual violence, the destruction of historical monuments, and the current measures to alter the demographic structure of the traditional Tamil homeland fit precisely with this international definition of genocide.

To confirm this, extensive reports were released, including the investigation report of the Office of the United Nations High Commissioner for Human Rights (OISL), and reports by Amnesty International, Human Rights Watch, and the International Crisis Group. The documentary “Sri Lanka’s Killing Fields” released by the British broadcaster ‘Channel 4’ has documented this in detail. Furthermore, the Permanent Peoples’ Tribunal, which met in 2010 and 2013, found the Government of Sri Lanka responsible for acts of genocide against the Tamils. Although the International Court of Justice has not ruled directly on Sri Lanka, its legal principles stating that “genocidal intent” can be proven through circumstantial evidence and proper documentation hold significant importance in this debate.

Even though the armed war was brought to an end in 2009, the structural genocide and the politics of annihilation by the Sri Lankan government against the Tamils did not end. Instead, they have intensified in different forms. Massive military camps still persist in the midst of civilian areas in the Northern and Eastern provinces where Tamil people densely reside. The daily lives of the people are intensely monitored. The ancestral and traditional lands of the Tamils are being confiscated under various legal pretexts such as “State Land”, “Security Zone”, “Forest Conservation Area”, and “Ancient Archaeological Site”. Due to this, Tamil fishermen face severe restrictions in their maritime livelihood, and farmers face constraints in accessing their agricultural lands, initiating a process designed to weaken the community economically.

At the same time, with the aim of completely changing the historical and spiritual identity of the Tamils, new Buddha statues and viharas are being systematically constructed in traditional Tamil villages and historical sites. Tamil place names are being Sinhalized. This is a subtle political effort to sever the historical antiquity of the Tamils from their land. Due to severe psychological stress, poverty, loss of parents and families, and continuous displacement caused by the war, Tamil students are facing a major setback in education. Preventing the intellectual growth of the future generation of a community is a form of long-term annihilation. Politically, the basic demands for self-determination of the Tamils continue to be rejected. Under the draconian Prevention of Terrorism Act (PTA), Tamil political activists, students, independent journalists, and human rights defenders still live under the shadow of fear today. Even Mullivaikkal commemoration events are subjected to strict government surveillance and bans.

Instead of providing appropriate justice to the affected Tamil people, the Sri Lankan government has been using delaying tactics by setting up various domestic commissions to escape from international pressure and accountability. All these domestic mechanisms have completely failed to unearth the truth and punish the war criminals. As a result, the confidence that the affected people had in the domestic judiciary has been completely shattered. However, the world has not forgotten these truths. The global Tamil diaspora communities, through their collective efforts, are preserving this history from fading in the international arena. Canada has officially recognized the month of May as “Tamil Genocide Education Month”. May 18 is observed as ‘Tamil Genocide Remembrance Day’ by Tamils living all over the world. Tamil organizations in many countries, including the United Kingdom (UK), Australia, France, Germany, Switzerland, Norway, and the United States, continue to bring remembrance, education, and political awareness events to the global stage.

Genocide is not an event that ends with bombs in a single day; it is a long-term process that shatters the political rights, land, economy, culture, and education of a nation, ultimately forcing that nation to lose its own identity. This is the continuous challenge that Tamils face today. That is why the Mullivaikkal commemoration is not just a sorrow of the past; it is a collective historical witness of the Tamil nation against the powerful forces trying to hide the truth. It is a tribute to those who lost their lives; a demand for justice for the forcibly disappeared; a persistent question placed before the world’s conscience along with the pain of the survivors.

Where is the justice for those who surrendered holding white flags in good faith? Where is the justice for the parents who handed over their children to the responsibility of the government, trusting them? Where is the justice provided by the international community for the bombed hospitals and the civilians buried in mass graves? Where is the historical justice for the denial of the basic political rights of an entire national identity?

The candle flame lit by Tamils living across the globe every year on May 18 is not just a symbol of tears. It is a collective pledge that the true history of a nation can never be erased by anyone. It is a solemn oath that the ultimate sacrifice of the Tamil people will not go in vain. It is a global political declaration that there can be no true peace without justice. Mullivaikkal is not just a memory to us; it is our political responsibility. Tamil genocide is not a past history to us; it is a reality that we face today. Until a proper answer to these global questions is achieved, Mullivaikkal will remain in the memory of the Tamils, the Tamil genocide will remain in the conscience of the world, and the struggle for justice will continue unceasingly at the center of Tamil history.

We will not forget. We will not forgive. We will not rest without justice.

#Nilavan
Journalist & Counsellor

The Mullivaikkal commemoration and the global voice of Tamils for justice are not mere temporary emotional outbursts or “crocodile tears.” It is a historical, political, and moral responsibility of the entire Tamil nation to deeply remember the tens of thousands of Tamil people who lost their lives in one of the most horrific humanitarian disasters […]

[1

0":"post-19704","1":"post","2":"type-post","3":"status-publish","4":"format-standard","5":"has-post-thumbnail","7":"category-1
["GET
